Lucas County, Ohio Arrest Records

Section 5924.09 of the Ohio Laws defines an arrest as the restraint of a person by direct or written order, not imposed as a punishment for an offense, directing the person to remain within certain specified limits. An arrest record in Lucas County is a document created by law enforcement when a person is taken into custody based on probable cause. The Ohio Bureau of Criminal Investigation (BCI) maintains a statewide criminal records database. The  Identification Division serves as Ohio's central repository for criminal records. Interested persons may request a criminal background check via BCI’s WebCheck system, which covers arrests reported to the state. This requires a small fee and either fingerprints or a name-based search. Criminal records from the Ohio State Highway Patrol may also be obtained from this agency. Alternatively, the Ohio Supreme Court’s portal provides access to case records across state courts. It includes dockets, criminal filings and dispositions.

Furthermore, interested persons seeking federal resources, individuals may request an Identity History Summary/Rap Sheet from the FBI. The FBI’s Interstate Identification Index contains arrest data submitted by law enforcement nationwide. One may request for these records online, via mail, or through an FBI-approved channeler. The Public Access to Court Electronic Records (PACER), which is maintained by the US Federal Courts, may release federal arrest records to registered users. They may obtain this information by searching for federal criminal court cases linked with arrests. This covers cases prosecuted by U.S. attorneys in federal district courts, including the Northern District of Ohio, which covers Lucas County.

Active Warrant Search in Lucas County

According to Section 2941.36 of the Ohio State Laws, a warrant is a document issued by a judge or magistrate, directing a law enforcement agent to take an accused person into custody. This document is typically issued when a judge or magistrate has probable cause to believe that the individual has committed a crime. This is based on evidence provided by law enforcement to convince the judge that the person was involved in a criminal activity. Arrest warrants may also be issued due to the failure of the individual to appear in court or comply with other legal obligations. Interested persons may look up arrest warrant-related information online by checking the Clerk of Court's Case Information search tool. Furthermore, one may contact a criminal defense attorney to perform the search to prevent the risk of immediate apprehension.

How to Find Arrest Records for Free in Lucas County

Members of the public may contact the Lucas County Sheriff's Office to find basic arrest records for free. Requests may be made via phone or in person. The county jail also regularly releases booking summaries to the general which shows information such as recent arrests, booking dates, charges, mugshots, and other arrest-related information. One may also search the Ohio Department of Rehabilitation and Correction Offender Search at no cost.

However, it is important to note that free searches come with certain limitations. Most online booking summaries only display recent records. Individuals seeking detailed, older records or police reports may need to visit the Sheriff's Office or other local law enforcement agencies in person. Record seekers may need to provide at least the full name of the incarcerated individual 

Some information, especially juvenile records, sealed or expunged cases, victim information, or sensitive investigative details, may also be redacted under Ohio public records laws. If you cannot find a record online, contact the sheriff’s office or the arresting police department directly. In some situations, a formal public records request or identification may be required for access to more detailed documents.

Lucas County Arrest Report

An arrest report in Lucas County is distinct from an arrest record. An arrest record is typically a brief summary showing that an arrest occurred, while an arrest report is the detailed narrative prepared by the arresting officer after the incident. How to Get an Arrest Record Expunged in Lucas County

Under Ohio laws, individuals may expunge or seal an arrest record depending on whether the arrest resulted in a conviction or a dismissal. One may apply for an expungement if the case was dismissed or acquitted. However, individuals who were convicted may first apply to have their record sealed and then expunged after 10 years. Lucas County follows Ohio state law for the expungement and sealing of arrest records. These procedures are governed by Sections 2953.31 to 2953.61 of the Ohio Revised Code and are not handled differently at the county level. Individuals eligible for expunction include those whose conviction is an eligible offense, whose charges were dismissed without conviction, or who were acquitted. Those who meet other specific criteria, such as waiting the appropriate length of time, no probation or current criminal charges pending are also eligible for expungement or sealing. 

To request an expunction,  individuals may start by finding out if they are eligible. They may then download, fill out and submit the Application for Record Sealing/ Expungement form along with other court documents, and file a petition with the Lucas County Court of Common Pleas. This may require a court hearing. If the petition is approved, the court judge will order law enforcement agencies and courts to remove or destroy the record. Record sealing provides an alternative for cases that do not qualify for a full expunction, as it limits who can see the record.

How Do You Remove Lucas County Arrest Records From the Internet?

Anyone who wishes to remove a Lucas County arrest record must begin by having the record expunged or sealed by the court that handled the case. Once a court order is issued for the sealing or expungement of an arrest record, that documentation can be used to remove the arrest record from public inspection. 

By using the sealing or expungement order, you can submit a removal request to local law enforcement agencies if your mugshot is still on the agency's site. Some websites may require the petitioner to submit an official copy of the court order, showing that the record was sealed, expunged, or that the case was dismissed.
